Pet Purchase Contract

                        

In the following contract agreed upon by both parties in a condition of sale of the Male/Female    

Scottish Fold Kitten              Microchip #______________________________

 

_____________________________________________ referred to as “The Breeder” and ______________________________________­­­­­­­­­­­­­­­­­­­   referred to as “The Buyer”.

 

In consideration of a purchase price of $____________ ($      non-refundable deposit), the Breeder transfers all rights, privileges and responsibilities associated with the ownership of the above described Kitten to Buyer with the following conditions subsequent.  Breeder and Buyer agree that Ontario laws apply to this contract and to have any dispute settled in an Ontario Court.

 

1. Health guarantee is that the kitten is free from any genetic problem that would keep the cat from living a normal life. In the event of a genetic health problem is determined or discovered before the kitten reaches the age of 12 months old a replacement kitten of equal quality from the next available litter will be due to the Buyer. The Breeder will in that case require a statement from and contact information of the Buyer’s veterinarian and concurrence with Breeder’s veterinarian before a replacement is provided. Should the veterinarian state that the health condition was caused by or contributed to by poor nutrition, an accident or injury, or anything beyond the scope of the Breeder’s responsibility; the health guarantee will not apply.

2. This kitten is guaranteed to be free of any disease at the time of sale. This kitten must be checked within 3 business days by a veterinarian of your choice or the health guarantee is null and void. If after the veterinarian’s assessment, the kitten is determined to not be free of any disease or illness then the Breeder will take this kitten back immediately for full refund.Transportation is the responsibility of the Buyer.

3. In case the kitten is returned during the first two weeks after purchase for non health reasons, the Breeder will refund the original purchase price (minus nonrefundable deposit)

4. In case kitten is returned after the first two weeks from the date of purchase, the Breeder WILL accept the kitten but NO REFUND WILL BE PROVIDED TO THE BUYER.

5. Purchaser agrees to neuter the kitten and at within 9 months of age.

6. The Purchaser further warrants that this kitten/cat: Will receive regular annual vaccinations and Will be given all necessary veterinary care that may be necessary to maintain its good health.
    

The Buyer DOES  NOT have the right to breed this kitten. Failure to comply with this requirement will entitle the Breeder to a monetary fine in the amount of $3,000.00 (Three thousand dollars), paid by the Buyer because of Breach of Contract. The Breeder’s reasonable attorney fees for recovery of the cat or the collection of the fine will be paid by the Buyer. Additionally, rights and ownership of the cat will immediately terminate and revert to the Breeder who may immediately assume possession of the cat. Any breech of this contract will result in the seller taking repossession of said kitten.
